These terms are an agreement between you and Bagged covering the Bagged iPhone app and this website. By creating an account or using Bagged, you agree to them. If you do not, please do not use the service.
Bagged, operated by Thomas Matera, an independent developer based in New Jersey, United States. Questions go to hello@baggedgolf.com.
1. Who can use Bagged
You need to be at least 13 years old to have an account, and where the law where you live sets a higher minimum age for agreeing to terms like these on your own, you must meet that age instead. If you are under the age of majority where you live, you may only use Bagged with the involvement of a parent or guardian who agrees to these terms.
2. Your account
You are responsible for what happens under your account, including keeping your password or Apple sign-in secure. Give us accurate information when you sign up, and tell us at hello@baggedgolf.com if you think someone else has got into your account.
One person, one account. Do not impersonate another golfer, and do not pick a username designed to make people think you are someone you are not.
You can delete your account at any time from inside the app. See the Privacy Policy for what happens to your data when you do.
3. What you post
Your logged rounds, your ratings, and your photos are yours. We do not claim ownership of them.
To actually run the service, we need permission to store and show them: you grantBagged a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display the content you upload, solely for the purpose of operating and improving Bagged and showing your content to the people you have chosen to show it to. This licence exists only so the app can work, and it ends when you delete the content or your account, subject to the backup window described in the Privacy Policy.
You are confirming, when you upload something, that you have the right to. Do not upload photos you did not take or do not have permission to use.
4. Acceptable use
Do not use Bagged to:
- Harass, threaten, impersonate, or abuse anyone.
- Upload content that is unlawful, hateful, or sexually explicit.
- Upload content you do not have the rights to.
- Scrape, crawl, or bulk-extract course data or other users’ profiles.
- Reverse engineer the app, probe our infrastructure, or attempt to bypass rate limits, authentication, or another user’s privacy settings.
- Automate account creation, follows, or logged rounds.
- Resell or commercially redistribute any part of the service.
We can remove content and suspend or terminate accounts that break these rules. Where it is reasonable to do so, we will tell you why.
You can block any golfer. Blocking hides each of you from the other and removes any follows between you in both directions; unblocking lifts the block but does not restore those follows. You can also report a golfer or a photo. We review reports and may remove content or close accounts, but we are not obliged to act on every report and we do not promise to tell you what we decided.
5. Course information
Course details in Bagged come from public data sources and from our own curation. Names, locations, par, and other details may be wrong or out of date: courses close, change hands, rebuild holes, and get renamed. Bagged is a record of where you have played, not a booking system and not a guide to what a course currently offers. Check with the course itself before you plan a trip around anything you read here.
If you find something wrong, tell us at hello@baggedgolf.com and we will fix it.
6. Logging, trophies, and points
Bagged is a record of rounds you have actually played. Logging courses you have not played is not a private fiction: it moves you up leaderboards other golfers are on and earns trophies their rarity is supposed to make hard. We may remove entries, revoke trophies, or close accounts where activity is clearly fabricated.
Trophies, tiers, and points are for fun. They have no monetary value, cannot be bought, sold, or transferred, and we may adjust how they are calculated as the app develops.
Rarity tiers, trophies, and rankings are our own editorial judgment and are meant to be fun. They are not an assessment of any course’s quality, and they are not endorsed by, affiliated with, or approved by any course, club, or publication we name.
7. Price and availability
Bagged is currently free to use. We may add paid features in the future; if we do, we will make the price and what it covers clear before you are charged, and anything you have already logged stays accessible to you.
We may change, suspend, or discontinue parts of the service. We will give reasonable notice before discontinuing it entirely, so you have time to get your data out.
8. Ending it
You can stop using Bagged and delete your account at any time, for any reason, from inside the app. We may suspend or terminate your account if you materially breach these terms, if we are required to by law, or if we discontinue the service.
9. Disclaimers
Bagged is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that course data will be accurate.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits rights you have under consumer protection law that cannot be waived.
10. Limitation of liability
To the fullest extent permitted by law, Bagged will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of Bagged.
Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
11. Apple
Because you got Bagged from the App Store, the following apply:
- These terms are between you and Bagged only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide any maintenance or support for Bagged.
- If Bagged fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claim you or a third party have relating to Bagged, including product liability claims, claims that it fails to conform to a legal requirement, and claims arising under consumer protection or similar legislation.
- Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that Bagged infringes intellectual property rights.
- You confirm you are not located in a country subject to a US Government embargo, or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12. Changes to these terms
We may update these terms. When we do, we will change the date at the top of this page, and for material changes we will give you notice in the app or by email before they take effect. Continuing to use Bagged after that means you accept the new terms.
13. Governing law
These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of laws rules. If you live somewhere whose law gives you the right to bring a claim locally, this does not take that right away.
